Burst Fruit Technology Co., Ltd. (hereinafter referred to as "the Company") establishes the following privacy policy (hereinafter referred to as "this Policy") regarding the protection of customers' personal information and will handle personal information appropriately based on this Policy.

The meanings of the terms used in this Policy shall comply with the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act").

1. Items of Personal Information to be Acquired

The Company mainly acquires the following personal information concerning customers:

  1. Information concerning identity verification: Gender, date of birth, mobile phone number, email address, account ID and password, Google ID.
  2. Information provided by the customer: Information concerning content uploaded or created by the customer, profile information, customer's photos and profile videos, comments posted by the customer, information entered for AI, survey responses, and contact information entered by the customer.
  3. Information concerning transactions: Information concerning transaction details and purchase history, etc.
  4. Information acquired upon use of the service: Online identifiers such as cookie IDs, device information used, browsing history, metadata concerning content (information on when, where, and at what time the content was created, the creator, how the image was created, adjusted, parameterized, etc.), clipboard information when using the paste function, information about the local album when access permission to the device's local album is granted, and other service usage status (including access logs, IP addresses, browser information, browser language settings, etc.).
  5. Information concerning advertisements: Information concerning access to our advertisements or introduction links.
  6. Other information: Information concerning inquiries and communications from customers to the Company, etc.

2. Purposes of Use

The Company acquires and uses customer's personal information within the scope of the following purposes of use:

  1. For registration for the service, identity authentication at the time of using the service, and customer management.
  2. For providing the service and after-sales service.
  3. For billing the consideration for the service.
  4. For making payments to customers.
  5. For prevention of and response to fraudulent activities, etc.
  6. For maintenance and management of the service.
  7. For investigation and analysis of marketing data, and for consideration and implementation of marketing measures.
  8. For providing, soliciting, advertising, and other marketing of the products and services of the Company or third parties in the Company's or third parties' media, tailored to the customer's interests and concerns based on analysis of the customer's attributes and behavioral history.

  10. For improvement of the service and for planning, research, and development of new products and services.
  11. For responding to inquiries and contacting customers.
  12. For provision to third parties as described in this Policy.

3. Provision to Third Parties

Except in the following cases, the Company will not provide personal information handled by the Company to a third party without obtaining the customer's prior consent:

  • When based on laws and regulations.
  • When it is necessary for the protection of a person's life, body, or property and it is difficult to obtain the customer's consent.
  • When it is particularly necessary for the improvement of public health or the promotion of healthy child development and it is difficult to obtain the customer's consent.
  • When it is necessary to cooperate with a national agency, a local government, or a person entrusted by them in performing the affairs prescribed by laws and regulations, and obtaining the customer's consent may interfere with the performance of those affairs.
  • Other cases permitted by laws and regulations.

Notwithstanding (1) above, the Company may provide personal information handled by the Company to a third party when entrusting part of the operations necessary for providing the Company's services (e.g., development, payment, security, and prevention of unauthorized use) to the third party.

These entrustees access only the minimum personal information necessary to perform the operations on behalf of the Company and do not use personal information beyond the scope of the entrusted operations.

The Company complies with applicable laws, screens the eligibility of each entrustee as an entrustee, enters into a data processing agreement, and takes measures to ensure that users' personal information is managed appropriately.

5. Requests for Disclosure, etc.

The Company responds to requests for disclosure, etc. (meaning notification of purposes of use, disclosure of personal information or records of provision to third parties, correction, addition, deletion, suspension of use, or suspension of provision to third parties) as follows:

Customers may request the Company to notify the purposes of use or disclose personal information or records of provision to third parties within the scope permitted by the Personal Information Protection Act in accordance with the procedures prescribed in (4).

However, the Company may not disclose such information in any of the following cases:

  1. When disclosure may harm the life, body, property, or other rights and interests of the person or a third party.
  2. When disclosure may cause significant hindrance to the proper implementation of the Company's business.
  3. When disclosure would violate laws and regulations.
  4. When it cannot be confirmed that the request for disclosure is from the person themselves.

Note that a disclosure fee prescribed in (4) will be charged for requests for notification of purposes of use or disclosure of personal information or records of provision to third parties.

(2) Correction, addition, or deletion

Customers may request correction, addition, or deletion of personal information in accordance with the procedures prescribed in (4).

In such a case, the Company will conduct an investigation without delay within the scope necessary for achieving the purposes of use and, based on the results, correct, add, or delete the personal information within the scope permitted by the Personal Information Protection Act.

(3) Suspension of use or suspension of provision to third parties

Customers may request suspension of use or suspension of provision to third parties of personal information in accordance with the procedures prescribed in (4).

In such a case, the Company will respond appropriately in accordance with the Personal Information Protection Act.

A fee of 1,000 yen will be charged per request for notification of purposes of use and disclosure of personal information or records of provision to third parties. The prescribed fee will also be charged in cases of non-disclosure or non-notification of purposes of use.

6. Handling of Cookies

The Company's website uses cookies and similar technologies for tracking or analysis (hereinafter collectively referred to as "Cookies").

Cookies are small files containing arbitrary characters that are exchanged between the web server and the viewer's Internet browsing software (browser) when the customer browses the website and are saved on the viewer's device. 9. Procedures for Changing the Privacy Policy

When changing this Policy, the Company will announce the timing of implementation and the content of the changed Policy by displaying it on the Company's website or other appropriate methods, or notify the customer.
